Confidentiality & Medical Records

The practice complies with GDPR, data protection and access to medical records legislation. 

In cases such as safeguarding we are legally obliged to share information with other legitimate agencies.

Reception and administration staff require access to your medical records in order to do their jobs. These members of staff are bound by the same rules of confidentiality as the medical staff.

Freedom of Information

Information about the General Practitioners and the practice required for disclosure under this act can be made available to the public. All requests for such information should be made to the Operations Manager.

Subject Access Request

Under the Data Protection Act (DPA), the General Data Protection Regulations (GDPR) and (for deceased individuals) the Access to Health Records Act 1990, you have a legal right to apply for access to health information held about you. This includes your NHS records held by a GP.

 

A health record contains information about your mental and physical health recorded by a healthcare professional as part of your care.

 

Who can make an Access Request?

An application for access to personal data may be made to the Practice by any of the following:-

    • an individual
    • a person authorised by the individual in writing to make the application on an individual’s behalf e.g. solicitor
    • a person having parental responsibility for the individual where he/she is a child
    • a person appointed by a court to manage the affairs of an individual who is deemed incompetent
    • individuals who hold a health and welfare Lasting Power of Attorney
    • where the individual has died, the personal representative and any person who may have a claim arising out of the individual’s death (the executor of the deceased’s will; someone who has been appointed as an Administrator of the Estate by the Courts; someone who has the written consent of either of the above to be given access, someone who is in the process of challenging the deceased’s will)

Individuals wishing to exercise their right of access can make a written application to the Practice or a verbal request.

 

Complaints

We make every effort to give the best service possible to everyone who attends our practice.

However, we are aware that things can go wrong resulting in a patient feeling that they have a genuine cause for complaint. If this is so, we would wish for the matter to be settled as quickly, and as amicably, as possible.

To pursue a complaint please contact the practice via email APGP.communications@livgp.nhs.uk who will deal with your concerns appropriately. Further written information regarding our procedure is available on request.

Zero Tolerance Policy

The Practice operate a zero tolerance policy towards abusive, threatening and racist behaviour and has the right to remove  patients from the list with immediate effect in order to safeguard practice staff, patients and other persons. This includes actual or threatened physical violence or verbal abuse which leads to fear for a person’s safety. In this situation we will notify the patient in writing of their removal from the list and record in the patient’s medical records the fact of the removal and the circumstances leading to it.

Charges You May Be Asked To Pay

You may be asked to pay a charge for some services at the practice. Our charging policy detailed below explains this.
